Our client faced serious allegations of sexual assault brought by his former partner, including a claim months later that their first encounter was non-consensual. On the eve of trial, she raised a further historical allegation, increasing the risk of prejudice. We successfully secured a judge-alone trial to ensure the matter was determined solely on the evidence. At trial, we exposed significant inconsistencies in her account and established a clear motive to fabricate. The trial judge accepted our argument in full, resulting in a complete acquittal.

Large Commercial Drug Supply & Manufacture

Our client faced multiple serious drug charges, including large commercial supply and manufacturing offences, while co-accused parties pleaded guilty and received lengthy prison sentences. We advised our client to proceed to trial, identifying that the prosecution could not establish knowledge or rely on the inferences sought from the evidence. At trial, we demonstrated that the police evidence was insufficient and failed to prove the essential elements of the offences. Our client was acquitted of all 11 charges, and on the defence’s application the Court ordered that our client’s legal costs be paid.

Illicit Tobacco Importation — $13M Excise Evasion

Our client was charged with illegally importing tobacco and evading approximately $13 million in excise duty, with the prosecution case being overwhelming. Following strategic negotiations, we entered pleas of guilty at an early stage, then meticulously prepared the sentence, placing significant emphasis on rehabilitation, personal circumstances and prospects. Despite the scale of the offending, the Court imposed a custodial sentence of just 15 months — well below what is typically expected for offending of this magnitude, an outcome authorities publicly criticised as a “slap on the wrist.”

Drug Supply — Over One Tonne of Cocaine

Our client was charged with an extremely serious drug supply offence involving over one tonne of cocaine. Despite the gravity of the allegations, we advanced a compelling bail application, demonstrating that his personal circumstances, combined with identifiable weaknesses in the prosecution case, justified his release. We further argued it would be unjust for him to remain in custody during what would be a lengthy delay before trial. The Court accepted our submissions and granted bail.

Sexual Intercourse Without Consent

Our client was charged with sexual intercourse without consent, despite clear weaknesses in the prosecution case. The prosecution remained determined to proceed to trial. We prepared and submitted detailed representations to the Office of the Director of Public Prosecutions, outlining the evidentiary deficiencies and the prospects of conviction. The DPP accepted our argument and discontinued the proceedings, sparing our client the significant financial and personal burden of a trial.

Drug Importation Allegation

Our client was arrested after collecting a package at the request of her former partner, which was found to contain a large quantity of prohibited drugs. We successfully secured her release on bail shortly after she was charged. Through strategic negotiations, we highlighted significant evidentiary deficiencies and demonstrated a clear and compelling inference that our client had no knowledge of the contents of the parcel. Within six months, the prosecution agreed to withdraw all charges.
